WWE supports Vince McMahon’s motion in Janel grant lawsuit in todays Wrestling news

WWE has sided with Vince McMahon against Janel Grant in the lawsuit.

The company filed a memo on Wednesday to support Vince McMahon’s motion to compel arbitral proceedings, disputing Grant’s allegations in this lawsuit.

“WWE disputes Grant’s allegations. This dispute cannot be heard by a court, because Grant agreed to arbitrate the claims. WWE moves to force this action to arbitration,” WWE stated in the filing.

Arbitration would mean that the case will be moved to private mediation instead of a public court. All three defendants (WWE, McMahon and John Laurinitis), who are involved in the lawsuit, support moving the case in this direction.

WWE said: “Simply put Grant has no claims that can be brought in this Court, because the separation and nondisclosure contract she signed with McMahon (the “Agreement “)–the financial benefits of which Grant concededly accepted and kept–contains a arbitration provision that clearly precludes this Court adjudicating on her claims,” WWE added.

WWE also stated that the arbitrator would ultimately decide which parts of a dispute should be resolved in arbitration.

“This action should be forced to arbitration. The Agreement, which Grant admittedly negotiated, agreed to sign, and accepted as beneficial, contains a clear, unambiguous arbitration clause. This provision requires that not only all claims Grant asserts in this case be decided in arbitral proceedings, but that the threshold question as to whether these claims are arbitrable be decided by an arbitration panel. The Court should grant WWE’s motion to compel arbitral and order that the claims be submitted to arbitration as the parties intended, and as the Agreement mandates.”

Grant cited the Speak Out Act and Victims of Trafficking and Violence Protecting Act of 2000 in her initial lawsuit as evidence that the NDA is not enforceable. WWE stated in their filing that both do not apply to arbitration.

Vince McMahon had filed a document earlier on Wednesday presenting “Statement Undisputed Material Facts”.
