Judge denies Vince McMahon’s motion to enforce stay in Janel Grant's lawsuit in todays Show_Type news

Vince McMahon’s motion to enforce the stay order of a federal court against Janel Grant was denied.

Grant filed a Connecticut petition last month to obtain records relating to her treatment at Peak Wellness with Dr. Carlon Collker, which she claims was arranged by McMahon. McMahon’s lawyers argued the following week that Grant’s filing of the petition violated a federal stay order placed on Grant’s June lawsuit against McMahon and WWE, as well as John Laurinaitis.

Jessica Taub, McMahon’s lawyer, said in response to Grant’s petition: “After telling the Federal Court she would pause the lawsuit, Ms. Grant violated the Stay Order immediately by seeking one-sided discoveries for her own benefit.”

McMahon’s lawyers asked the Court to prevent Grant from obtaining materials from Peak Wellness. They also requested that Grant be punished for contempt and financial sanctions.

Grant’s attorneys responded that the petition was not subject to the federal order of stay since it was filed by a state court. Neither Dr. Colker or Peak Wellness were named as defendants in Grant’s lawsuit against McMahon.

Ann Callis, Grant’s attorney, responded: “We did violate a federal stop by filing a state lawsuit against a non defendant.”

Today, Judge Jeffrey A. Meyer decided that the stay order did not apply to Grant’s petition to Peak Wellness to obtain medical records.

The Court does not interpret the stay order as applying to state court proceedings outside the scope of the discovery prescribed by the Federal Rules of Civil Procedure that govern the conduct of discovery during federal court litigation.

“Federal District courts do not normally regulate or review proceedings in state court, and the Court’s stay order did NOT purport to apply to any state Court proceedings.” If there is an objection to state court proceeding, relief should be sought in state court and not in this Court. The Court therefore DENIES defendant McMahon’s motion to enforce the Court’s stay order because McMahon failed to prove that the Court’s stay order had been violated. It is ordered.”
