A lawsuit was filed against AEW.
Kevin Kelly and The Boys, (Brendan Tate and Brandon Tate), have filed a lawsuit against the company.
Kelly claims defamation by Ian Riccaboni, AEW and AEW. This stems from Riccaboni’s comments on a Discord channel about Kelly mentioning a movie on air that was linked to QAnon conspiracy theories. He claims that AEW violated his contract, and that this has made it hard for him to find other work. Kelly was fired by AEW in march.
The Tate Twins lost their jobs in April. Tony Khan publicly stated that their release was due to no-showing, which the Tate brothers later attributed a miscommunication with management after they had been booked to fly out of an airport other than they usually use. The brothers’ defamation lawsuit against Khan and AEW is based on the claim that they no-showed their events.
Kelly and the Tate Twins also request that the court certify a collective action suit against AEW for misclassifying their talent as independent contractors instead of employees.
“I applaud these Plaintiffs for their bravery in bringing the long-overdue lawsuit, challenging the misclassification of pro wrestlers as independent contractors rather than employees. Stephen P. New, an attorney, said, “We know we’re in for a hard, long fight, but I believe justice will always prevail.”
The Wrestling News AV broke the news first.
“BREAKING News: Three former talent terminated by the company filed a lawsuit against All Elite Wrestling and others. The suit was brought by announcer Kevin Kelly, wrestlers Brandon & Brendan Tate and attorneys Stephen P. New & Benjamin Baer on August 30, in the Philadelphia County Court of Common Pleas, Pennsylvania. It seeks to void arbitration clauses of their talent contracts and request the court certify a group-action lawsuit against AEW for claims that the company misclassifies its wrestling talent as independent contractor, rather than employee.
“In April, there was a report that the Tate Brothers (known professionally as “the Boys”) were released from their Ring Of Honor contract due to budget cuts. ROH owner Tony Khan claimed in media events that the Tate Brothers’ release was due to their no-showing at several events. The brothers deny this claim. This claim is at the heart of the defamation complaint against Khan by the Tate Brothers.”
Kelly, who worked as the English-speaking commentator for New Japan in June 2023, was fired in March from his position as AEW’s play-by-play broadcaster after he publicly expressed his frustrations on social media.
